  1. Legal Agreement

  1. Use of this site, signifies your agreement to all of the following terms. We reserve the right , at our sole discretion, to change, modify, add to, or otherwise alter these policies at any time. Such changes and/or modifications shall become effective immediately upon their posting, so please review the Terms and Conditions posted at this link periodically. If you do not agree to all of the policies, you must not use the Digi-Petz site.

  1. Requirements and Limitations

  1. All individuals under the age of 13, are required by law to have prior consent of their parent/legal guardian, in order to transmit information through any of our services.

  2. All information, documents, artwork, text, etc. transmitted through our services will become, at our discretion, our property, which we may use as desired.

  3. Our services must not be used to promote your commercial desires.

  1. Equal Treatment Act

    1. This act was adopted in July 24th of 2006. It states that all users must be treated equal, and be given equal access to all of our services. No user will be discriminated due to the the basis of race, color, national origin, sex, religion, age, disability, political beliefs, sexual orientation, or marital or family status. Justice of our staff will balance that of our members. If for any reason you feel you have been discriminated, please contact our legal group at the Abuse Department.

  2. Maintained Conduct

  1. We must maintain a clean, friendly environment. To do so, we must prohibit numerous acts of behavior.

    1. The proceeding behavior is deemed unacceptable:

      1. Individual or group personal attacks of any individuals.
      2. Account Names, Pet Names, Titles, etc. which directly or indirectly constitute a violation of this disclaimer.
      3. Cheats, hacks, or scams, including links to third party hosting of such content.
      4. Private or personal information, which may identify another individual, with out their prior permission.
      5. Reference or links to any third party commercial web sites.
      6. Disrespect or neglect of employees, and their statements.
      7. Any information which we deem inappropriate for this site.
    2. Through posting information to this site, you must not host any content which constitutes the following. This includes, but is  not limited to content related to, or deemed; profanity, inappropriate or sexually-related, religious, political, overzealously offensive, racist, rude, obscene, commercial, or any other form of content we or any other user find unsuitable.

      1. Furthermore, we prohibit the following from postings on this site; libelous, pornographic, defamatory, threatening, invasive, encouraging of a criminal offense, violating of rights, or otherwise violate any law or give rise to liability.

    3. Derivative works posted must be published only by those who are licensed to reproduce the elements.

  2. All forms of harassment and discrimination should be immediately brought to the attention of our administrators. We will make every attempt to deal with all parties to eliminated any issues. In the event that we are unable to resolve an issue, at your discretion, you may file legal charges with your local authorities, which may contact us for information regarding the suspect.

    1. Harassment is defined as: to disturb persistently; torment, as with troubles or cares; bother continually; pester; persecute.

    2. Discrimination is defined as: to make a distinction in favor of or against a person or thing on the basis of the group, class, or category to which the person or thing belongs rather than according to actual merit; show partiality

  3. Consumers of our services, must maintain necessary boundaries.

    1. This includes, but is not limited to:

      1. Restraint from employee functions, server tools, control panels, or databases.

      2. Prohibition of any software, scripts, or content which could pose a threat to our servers, consumers, or regular feature conduct.

  4. Imitation or impersonation of an authority figure is considered unacceptable, and will not be tolerated.

  5. Taking advantage of any glitch will not be permitted, and it is of your responsibility to make an attempt to contact an employee for assistance.

  6. Commercial use of our services, to promote a third party, will be prohibited, and deemed unlawful.

    1. Google Adsense content on any of our web pages, must remain visible while using our services, in order to make our services available.

  1. Miscellaneous
    1. Please look into our Privacy Policy and Parental Consent documentation. These may be used as reference to resolve any questions or concerns you may hold.
    2. Misconduct, by failing to abide by all policies in act at such time, can constitute punishments by employees, over seen by our Administration.

  1. We maintain sole ownership over all content through our divisions, and related work.

  2. If you have found data under any of our divisions, which you believe may be copyrighted to you, and that your copyright has been infringed, you should immediately contact our administration with the following information:

    1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest;
    2. A description of the copyrighted work or other intellectual property that you claim has been infringed;
    3. A description of where the material that you claim as infringing is located on the division, with including the location of such material;

You are not permitted or authorized to copy, reproduce, republish, upload, post, transmit, or distribute materials from our divisions in any way or by any means, rather than personal, noncommercial use only, provided you include "Copyright © 2005-2008 BTW Media, llc. ~Used with Permission" on every page containing copyrightable elements and you keep intact other proprietary notices.
  4. By transmitting data through to to Digi-Petz, you, and/or your legal guardian automatically grant warrant to BTW Media llc, a perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, and distribute such materials or incorporate such materials into any form, medium, or technology.
